Our team has extensive experience in advising charities in connection with regulation both by the Office of the Scottish Charity Regulator (“OSCR”) in Scotland and the Charity Commission in England and Wales.
We can assist with all aspects of setting up a new charity, from initial tax advice to choosing the appropriate legal form, such as a trust, Scottish Charitable Incorporated Organisation (“SCIO”), unincorporated association or charitable company. We can also advise on how the charity should operate.
We will ensure your charity complies with the charity test, and can also register the charity for charitable status with OSCR, and HM Revenue and Customs (“HMRC”).
It is important that trustees are compliant with the various duties incumbent upon them as charity trustees. We will help ensure this by providing services such as the preparation of annual accounts, reclaiming tax, Gift Aid claims, providing trustee training and attending and advising at regular trustees’ meetings.
In addition to acting for charities, we also provide advice to individual clients on the benefits of charitable gifting during their life and in the event of their death. For clients who do not have immediate family, a charitable trust is often an ideal solution.

Following Jeremy Hunt’s first budget back in October the changes, or lack thereof, of previous Chancellors will really begin to bite for taxpayers in 2023. Although we may manage to stave off a technical recession it is likely the UK economy will contract for at least one quarter. What is The Trust Registration Service?
The Trust Registration Service is an online service which assists Trustees to adhere to their registration obligations under the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017.
New regulations came into force in October 2020. The new regulations mean that there is an increase in the number of trusts that fall into the ‘need to be registered’ category.
